GENERAL CONDITIONS FOR THE REGISTRATION OF CANDIDATES

GRUPO BINTERNATIONAL SL, with registered office at Diego de León 57 2º centro derecha, 28006, Madrid and with email address info@grupobinternational.com, holder of tax identification number ES-B86498268 (hereinafter “Grupo Binternational”), is the owner of the website grupobinternational.com and is registered in the Registro Mercantil de Madrid, volume 30071, folio 30, section 8, entry 11 with page M-541285.

Grupo Binternational reserves the right to modify without prior notice, the design, presentation and/or configuration of this website, some or all of the services provided, as well as to add new services. Grupo Binternational also reserves the right to modify or change this document in order to adapt it to current legislation applicable at all times, to new jurisprudential developments and to standard market practices.

Due to the constant changes in the labour market and given that the Grupo Binternational is constantly growing and applying new tools, it reserves the right to modify these Terms and Conditions at any point in their clauses. Therefore, the user is recommended to periodically read these terms and conditions.

By registering as a user on grupobinternational.com, the Candidate accepts these provisions (General Conditions of Registration of Candidates) in the version published by Grupo Binternational at the time the Candidate accesses the website “grupobinternational.com”.

PURPOSE OF REGISTRATION WITH GRUPO BINTERNATIONAL

Registration with Binternational.net Group as a Candidate is completely free of charge.

The purpose of the Candidate’s registration is to become part of a database owned by Grupo Binternational, through which Grupo Binternational will use the information provided to offer the candidate the possibility of finding a paid job according to his/her profile.

This service consists of facilitating, through the Grupo Binternational, access to the labour market by selectively disseminating your work/professional profile among employers in any country in the world who may be interested in finding a person with the same or similar work/professional profile to that of the registered Candidate.

In order to fulfil the aforementioned purpose, the Candidate shall expressly authorise Grupo Binternational at the time of completing his/her registration for Grupo Binternational to send his/her job/professional profile to any employer who, in Grupo Binternational’s opinion, may be interested in the candidate’s profile in order to offer him/her financial remuneration in exchange for a job.

The job/professional profile provided by the Candidate to Grupo Binternational must necessarily contain the following information:

The Candidate’s personal identity: name and surname, date and place of birth.

City and country of residence, telephone number and e-mail address.

Optionally, the candidate, after having completed the registration, may fill in the rest of the relevant information for the purpose set out above.

Failure to provide any of the above information will prevent Grupo Binternational from sending the job/professional profile to the Candidate’s potential employers.

The Candidate shall declare upon registration that all the information provided at the time of registration is true. The Candidate declares that the data provided after registration, either by inclusion or modification, is true.

The Grupo Binternational does not allow persons under eighteen years of age to register as Candidates.

The Candidate registered with Grupo Binternational shall state when completing his/her registration that he/she is over eighteen years of age.

USE OF REGISTRATION BY THE GRUPO BINTERNATIONAL

The job/professional profile of the registered Candidate will be forwarded by Grupo Binternational to potential employers who may be interested in his/her job/professional profile.

Grupo Binternational reserves the right to deregister and block the access of a registered Candidate to the area reserved for registered users if the Candidate has acted in a way that breaches any of these General Terms and Conditions or if he/she engages in specific activities or acts detrimental to Grupo Binternational.

COMMUNICATIONS BETWEEN THE REGISTERED CANDIDATE AND GRUPO BINTERNATIONAL

Ordinary communications between the registered Candidate and Grupo Binternational shall always be made by the usual means of communication, such as the email or telephone number provided by the Candidate during the registration process.

Grupo Binternational assumes no responsibility for the possible lack of truthfulness of the data included by the Candidate in the registration process and in his/her job/professional profile. Consequently, neither does it assume any responsibility for any detrimental effects for the registered Candidate or for third parties that may arise from untruthful data that the registered Candidate has provided to Grupo Binternational and that the latter has in turn provided to potential employers interested in his/her job/professional profile.

Grupo Binternational assumes no responsibility for any detrimental effects of any kind that may arise for the registered Candidate as a result of the employment/professional relationship that he/she may establish with the employer as a result of Grupo Binternational’s mediation in the communication between the two.

Grupo Binternational assumes no responsibility for the management, development and outcome of communications that may be maintained between the Candidate and the employer interested in his/her job/professional profile sent by Grupo Binternational.

Grupo Binternational does not guarantee the correct and permanent operation of the service through the Internet network, i.e. the uninterrupted availability of the service. Consequently, Grupo Binternational accepts no liability whatsoever for any breakdowns in the technical installations or the quality of access to the service due to force majeure or due to incidents not attributable to Grupo Binternational (e.g. breakdowns in communication networks or network servers).

Grupo Binternational shall not be in breach of these clauses if events beyond its control or caused by force majeure prevent Grupo Binternational from providing its services in accordance with these General Conditions of Candidate Registration.

RESPONSIBILITIES OF THE REGISTERED CANDIDATE

The registered Candidate assumes all legal responsibility that may arise from the data provided by him/her to Grupo Binternational, both during the registration process and subsequent actions (modification of data) as well as those included in his/her work/professional profile provided by him/her to Grupo Binternational for selective sending to potential employers. The Candidate registered with Grupo Binternational declares that by registering he/she is not pursuing a purpose other than that expressed in these General Conditions of Candidate Registration.

The Candidate undertakes to make diligent use of the Website and the services accessible from it, in full compliance with the Law, good customs and these Terms and Conditions, as well as to maintain due respect for other Users.

All information provided by the Candidate through the services must be truthful. To this end, the Candidate guarantees the authenticity and veracity of all data provided as a result of the completion of the forms required to subscribe to the Services. The Candidate also guarantees that he/she is over 18 years of age. 

The Candidate shall be responsible for keeping all the information provided permanently updated so that it corresponds, at all times, to the Candidate’s real situation. In any case, the Candidate shall be solely responsible for any false or inaccurate statements made and for any damage caused to InfoJobs or third parties as a result of the information provided.

The Candidate undertakes to respect applicable laws and the rights of third parties when using the contents and services of the Website. Likewise, the reproduction, distribution, transmission, adaptation or modification, by any means and in any form, of the contents of the Website (texts, designs, graphics, information, databases, sound and/or image files, logos, etc.) and other elements of this Website is prohibited, except with prior authorisation from their legitimate owners or when permitted by law.

The registered Candidate undertakes not to upload data to the Grupo Binternational’s website containing computer viruses (contaminated software) or software or other material protected by copyright or commercial rights protected by law, unless the Candidate is the owner of the relevant rights or has been granted permission by the owner to use such software, in which case he/she must request and obtain prior written permission from the Grupo Binternational.

The Registered Candidate agrees not to attempt to intercept e-mail messages from other Grupo Binternational registered Candidates.

The registered Candidate shall be solely responsible for the use made of the website and its services, and for any damages that may be caused to Grupo Binternational and third parties for breach of these General Conditions of Candidate Registration, and is therefore obliged to compensate Grupo Binternational and third parties for any damages caused.

CONTENT PROVIDED BY THE CANDIDATE

Grupo Binternational does not permit the distribution, management or communication of content that deteriorates the quality of the service. The provision of content is prohibited:

– That are presumably illegal by national, community or international regulations or that carry out presumably illegal activities or contravene the principles of good faith.

– That do not meet the quality parameters established by Grupo Binternational.

– That violate the fundamental rights of individuals, lack of courtesy on the network, disturb or may generate negative opinions in our Candidates, Companies or third parties and in general any content that Grupo Binternational considers inappropriate.

– That contain sensitive data (i.e. data related to ideology, religion, beliefs, trade union membership and information relating to racial origin, health and sex life).

– And in general that contravene the principles of legality, honesty, responsibility, protection of human dignity, protection of minors, protection of public order, protection of privacy, consumer protection and intellectual and industrial property rights.

Grupo Binternational reserves the right to remove, without prior notice, from the website any content that is considered inappropriate for its characteristics and purposes, as well as allegedly unlawful.

The Grupo Binternational cannot control each and every one of the contents published, and cannot assume responsibility for said contents.

INTERNATIONAL OFFERS

If the candidate sends his/her CV to any of the published offers, he/she expressly and unequivocally consents to the international transfer of his/her data, even to countries that do not provide a level of protection comparable to that provided by the GDPR in force in Europe. The sole purpose of this transfer of data will be to carry out the selection process that the company and/or collaborator has initiated, and the candidate’s data may not be used for purposes other than this. In the Spanish Data Protection Agency, users may consult which countries provide a level of protection comparable to the RGPD.

Similarly, the candidate consents to the transmission of data to international companies and/or collaborators who wish to access their personal data by consulting the Grupo Binternational database (without the need to publish an offer), even if their countries of origin do not provide a level of protection comparable to the RGPD. Similarly, by sending us your CV and submitting the form, you authorise access to your data by third parties located in countries with a level of data protection that is not equivalent.

INTELLECTUAL AND INDUSTRIAL PROPERTY RIGHTS

All exploitation rights are reserved. All rights to programs, services, procedures, software, technologies, trademarks, trade names, inventions, materials belonging to Grupo Binternational are the exclusive property of Grupo Binternational. The Grupo Binternational is the owner of all the listed rights of use. The use of all programs and the contents, materials, trademarks and trade names contained therein is only permitted for the purposes set out in these General Terms and Conditions. Reproduction of the programs, services, procedures, software, technologies, trademarks, trade names, inventions, materials belonging to Grupo Binternational is strictly prohibited unless Grupo Binternational grants express permission to do so.

The legitimacy of the intellectual or industrial property rights corresponding to the content provided by the candidates is the sole responsibility of the candidates.

SECURITY

Grupo Binternational has adopted the necessary technical and organisational measures to guarantee the security and integrity of the personal data contained in the file, as well as to avoid its alteration, loss, processing or unauthorised access, all in accordance with the provisions of article 32 of the RGPD, which regulates the security of processing and imposes on data controllers and processors the obligation to implement appropriate technical and organisational measures to ensure a level of security appropriate to the risk, for which they must take into account the state of the art, the costs of implementation and the nature, scope, context and purposes of the processing, as well as the risks of varying likelihood and severity for the rights and freedoms of natural persons.

COOKIES

The candidate accepts the use of cookies and IP tracking. Like most websites, Grupo Binternational uses cookies and web log files to track the use of the platform.

A cookie is a small data file that resides on the user’s computer and allows Grupo Binternational to recognise the user each time they access the platform with the same terminal and web browser. If the configuration of the user’s computer does not allow cookies, you will not be able to use the Grupo Binternational website.

Activated cookies will be updated each time the candidate enters the website with their login details. However, if you wish, you can deactivate and/or delete these cookies by following the instructions of your Internet browser.

LINKS TO THIRD PARTY SITES

Grupo Binternational includes within its contents links to sites belonging to and/or managed by third parties in order to facilitate access to information available on the Internet.

Grupo Binternational does not assume any responsibility derived from the existence of links between the contents of this site and contents located outside this site or any other mention of contents external to this site. Such links or mentions are for information purposes only and in no case imply support, approval, marketing or any relationship between Grupo Binternational and the persons or entities that are the authors and/or managers of such content or owners of the sites where they are located.

APPLICABLE LEGISLATION AND JURISDICTION

These General Conditions shall be governed by Spanish law.

For any discrepancy in the interpretation, application, compliance or non-compliance with the provisions herein, Grupo Binternational and the Candidate expressly submit to the Courts and Tribunals of the city of Madrid.

GENERAL CONDITIONS FOR COMPANIES

Grupo Binternational reserves the right to modify without prior notice, the design, presentation and/or configuration of this website, as well as some or all of the services, and to add new services.

The Client’s logo will be provided so that it can be published together with the job offer unless the Client expressly declares its will to the contrary. The user shall hold all copyright and author’s rights to the aforementioned logo, and Grupo Binternational shall not be liable for any illegitimate use thereof.

The Client authorises Grupo Binternational to send him/her information on potential candidates by e-mail.

Grupo Binternational reserves any right, in its sole and absolute discretion, to refuse to offer its services to any company or organisation.

Offers of employment that discriminate on the basis of sex, race or disability are unlawful and may result in proceedings against the advertising company. Any company that provides an offer that contravenes the law shall assume sole responsibility for the damages and consequences arising therefrom, exempting Grupo Binternational from any liability.

Grupo Binternational will immediately remove such offers without the prior consent of the Company. 

It is not permitted to publish any contact details/web links in the content/title of the vacancy. In case of publication of contact details / web links in the vacancy, Grupo Binternational will edit the content by removing such contact details / web links.

The contracted services that Grupo Binternational shall provide to the Client are exclusively those expressed in the contract and for the purpose stated in this document.

The Customer undertakes to use the Grupo Binternational’s service exclusively for the purpose stated in this document.

SERVICES

Grupo Binternational is a consulting company that offers its national and international clients the diagnosis of their organisation to accompany them in their strategic challenges from three perspectives: People Management, Organisational Transformation and Sustainability. The conditions of this service will be regulated through a contract signed by both parties.

INTRA-COMMUNITY CIF

In the event that the client has an intra-community VAT number, he/she will have the right to contact the financial department to request a rectifying invoice for the equivalent value of the tax charged. To do so, the customer must send an email to b.calvo@grupobinternational.com with the subject “Invoice amendment” indicating the intra-Community VAT number in the body of the email.

Grupo Binternational will proceed to verify the information provided and, if positive, will refund the part corresponding to the tax charged as soon as possible.

ENTRY INTO FORCE   

This stipulation comes into force from the moment the service provision contract is formalised by the signature of both parties and the General Terms and Conditions have been accepted, as well as the GDPR regulations that came into force on 25/05/2018.

ABOUT THE RESPONSIBILITIES OF THE GRUPO BINTERNATIONAL

As a measure against the falsification of documents (candidates in bad faith), Grupo Binternational cannot assume any responsibility for the possible lack of veracity of the data provided by the candidates in their C.V., nor for the data subsequently provided by the candidate to the Client. Consequently, neither can it assume any responsibility for any detrimental effects for the Client or for third parties that may arise from untruthful data provided by the candidate.

Grupo Binternational is not responsible if the candidate, once the contract with the Client has been concluded, communicates his or her voluntary resignation.

Grupo Binternational assumes no responsibility for any detrimental effects that may arise from the relationship that is initiated between the Client and the candidate for the job position in its corporate organisation, and also assumes no obligation or responsibility for the management, development and possible unsuccessful or detrimental outcome of the interviews or communications that may be held between the Client and the candidate for the job position.

In the event that the Client makes a claim against Grupo Binternational for any reason whatsoever, Grupo Binternational’s liability (if any) shall not exceed the price paid, or payable, for the Services by the Client. In no event shall Grupo Binternational be liable for any consequential, direct, indirect or special losses resulting from any loss of profit, revenue, interest, goodwill, or otherwise in connection with the business.

In relation to the publication of job offers Grupo Binternational shall provide the contracted services using the information and criteria supplied by the Client. It is the Client’s responsibility to provide accurate and up-to-date information.

Delays in the publication of vacancies due to Spanish holidays shall not be attributable to Grupo Binternational.

Grupo Binternational shall not be in breach of these clauses if events beyond its control or caused by force majeure prevent Grupo Binternational from providing its services in accordance with these General Terms and Conditions for companies.

REGARDING THE CLIENT’S RESPONSIBILITIES

The Client undertakes to treat as confidential the data (especially names, postal addresses, e-mail addresses, telephone or fax numbers), e-mails, other messages and notifications of candidates for jobs in its organisation with whom it has established communication through the Grupo Binternational.

The Client declares that in contracting with Grupo Binternational, it is not pursuing any purpose other than that expressed in the object of this contract, i.e. to request candidates from Grupo Binternational that it needs to fill positions in its business organisation.

All information provided by the Company through the services must be truthful. For these purposes, the Company guarantees the authenticity and veracity of all data provided as a result of filling in the forms required to subscribe to the Services.

Likewise, it is the responsibility of the Company to keep all the information provided to the Grupo Binternational permanently updated so that it corresponds, at all times, to the real situation of the Company. In any case, the Company shall be solely responsible for any false or inaccurate statements made and for any damage caused to InfoJobs or third parties as a result of the information provided.

The Company undertakes to respect the applicable laws and the rights of third parties when using the contents and services of the Website.

INTELLECTUAL PROPERTY

All exploitation rights are reserved. All rights to programs, services, procedures, software, technologies, trademarks, trade names, inventions, materials belonging to Grupo Binternational are the exclusive property of Grupo Binternational. The Grupo Binternational is the owner of all the listed rights of use. The use of all programs and the contents, materials, trademarks and trade names contained therein is only permitted for the purposes set out in these General Terms and Conditions. The reproduction of programs, services, procedures, software, technologies, trademarks, trade names, inventions, materials belonging to Grupo Binternational is strictly prohibited unless expressly authorised by Grupo Binternational.

CONFIDENTIALITY

The Parties agree to maintain strict confidentiality regarding any data or information provided by one of the Parties to the other, to which they have had access and/or of which they become aware as a result of the collaboration that constitutes the object of this Agreement, in particular any information relating to technical knowledge, know-how, methodologies, products, services, clients or commercial activities of the other Party (hereinafter, the Confidential Information) not allowing such information to be transferred or made accessible to third parties not expressly authorised, with the exception of the personnel in the service of either of the Parties.

The confidentiality obligations set forth in this Clause shall remain in force during the term of this contract, and shall survive indefinitely after the termination of this contract.

Any infringement of these rights may give rise to appropriate civil or criminal judicial or extrajudicial proceedings.

PRINCIPLE OF PRESERVATION OF THE CONTRACT

The invalidity or invalidity of any provision or provisions of these General Terms and Conditions shall not affect the validity of the remaining provisions. Insofar as individual provisions are to be excluded or rendered invalid, they shall be replaced by the applicable statutory provisions.

These General Terms and Conditions are subject to the laws of the Kingdom of Spain.

APPLICABLE LAW AND JURISDICTION

 These General Terms and Conditions shall be governed by the laws of Spain.

Any discrepancies that may arise between the contracting parties arising from the conclusion and development of this contract shall be submitted to the Courts and Tribunals of the city of Madrid.
